Tax resolution means getting a tax problem with the IRS, the California Franchise Tax Board or the CDTFA closed out: the notice answered, the audit finished, the balance on a payment plan, and penalties removed where the rules allow. At TT Tax, that work is done by Kathy Nguyen, an IRS Enrolled Agent (license 112737), from our office at 12112 Brookhurst St in Garden Grove. You talk to the person handling your case, not a call center.

Why use a local Enrolled Agent for tax resolution?

An Enrolled Agent is licensed by the IRS itself and can represent you before the IRS on audits, collections and appeals. Once you sign a power of attorney (IRS Form 2848), the IRS talks to us instead of you. Many national tax relief companies advertise on radio and TV, take your case over the phone and hand it to whoever is free. We work the other way:

Tax resolution services we provide

IRS, FTB and CDTFA notices

Send us the letter. We read it, pull your return and records, and tell you whether the agency is right. Where it is wrong, we respond in writing with the paperwork to prove it. Where it is right, we work out the cheapest way to close it.

IRS audit representation

We prepare the documents the examiner asked for, answer questions on your behalf, and keep the audit to the years and items in the notice. CDTFA sales tax audits are handled the same way.

Unfiled returns

If returns are missing, the IRS may file a substitute return for you that ignores your deductions. We prepare the late returns properly, file them, and use them as the starting point for everything else.

IRS payment plans

We set up installment agreements with the IRS and with the FTB, sized to what you can actually pay each month. A payment plan stops most collection action while you stay current on it.

IRS penalty abatement

Penalties for filing or paying late can often be removed. We request first-time abatement where you qualify and reasonable cause relief where something outside your control caused the problem.

Offer in compromise

We assess whether you are a real candidate before you spend money applying, and prepare the offer if you are.

How does an IRS payment plan work?

An IRS payment plan, formally an installment agreement, lets you pay a tax balance in monthly installments instead of all at once. Interest and some penalties keep running until the balance is paid, so the plan is a way to stop the pressure, not a discount. To keep a plan in good standing you have to file future returns on time and pay future taxes in full. The FTB runs its own installment program for California balances, and we usually set up both at once so one agency is not paid at the expense of the other.

Can IRS penalties be removed?

Yes, IRS penalties can be removed in two common situations. First-time abatement applies to failure-to-file, failure-to-pay and failure-to-deposit penalties when you have no penalties in the prior three tax years and your filings are current. Reasonable cause relief applies when something like a serious illness, a death in the family, a disaster or bad written advice kept you from complying. Penalty abatement does not remove the tax itself or, generally, the interest on it, but on an old balance the penalties can be a large share of what is owed.

What is an offer in compromise, honestly?

An offer in compromise is an agreement to settle a tax debt for less than the full amount, and the IRS accepts one only when it concludes it cannot reasonably collect the full balance. The IRS looks at your income, your necessary living expenses and the equity in what you own. If those show you can pay the balance over time, the offer will be rejected and a payment plan is the better route. The FTB and the CDTFA have their own offer programs with their own rules. Advertisements that promise to settle tax debt “for pennies on the dollar” leave out that most people do not qualify. We will tell you plainly whether you are likely to, before you pay an application fee.

What to do when a tax notice arrives

  1. Do not ignore itEvery notice has a response date. Missing it can cost you appeal rights and move the case into collections.
  2. Send it to usEmail a photo or scan to kathy@tttax.net, or bring it to the office. Include the return for the year in question if you have it.
  3. Get a planWe tell you what the agency is claiming, whether it is correct, what your options are, and what happens next.

Stay out of trouble next year

Once your case is closed, our monthly bookkeeping, tax preparation and sales tax filing keep the records ready if an agency asks again.

Questions clients ask us

What is an Enrolled Agent, and can one represent me before the IRS?

An Enrolled Agent is a tax professional licensed by the IRS. Enrolled Agents can represent taxpayers before the IRS on audits, collections and appeals. Kathy Nguyen is an IRS Enrolled Agent, license 112737.

Will the IRS stop calling and writing to me?

Once you sign IRS Form 2848, a power of attorney, the IRS can deal with us directly about the years it covers. You still receive copies of notices, but we handle the responses and the calls.

Do you handle California tax problems too?

Yes. We handle Franchise Tax Board notices and payment plans for California income tax, and CDTFA notices and audits for sales tax, alongside the federal side of the case.

I have not filed for several years. Can you help?

Yes. We prepare the missing returns, file them, and then work out how to handle any balance, whether that is a payment plan, penalty relief or another option.

Can you guarantee you will reduce what I owe?

No one can honestly guarantee that. The IRS, FTB and CDTFA decide based on their rules and your facts. What we can do is tell you which options fit your situation and pursue them properly.
